1. SCOPE

Your privacy is important to us. This Privacy Notice describes the types of personal information that Herc Rentals Inc. (“Herc Rentals”) and its affiliated companies, including Matthews Equipment Limited o/a Herc Rentals (collectively, “we”, “us”, “our”) may collect from and about you when you visit www.HercRentals.com or any other of our websites or social media properties where this Privacy Notice is posted (each a “Site”), visit one of our U.S. or Canadian equipment rental locations (“Rental Locations”), use our mobile applications, including the Herc Rentals ProControl mobile application (each an “App”), or otherwise interact with us or request services from us as described further in this Privacy Notice.

We may also collect or receive personal information about you as part of a business acquisition, merger, or restructuring, based on our legal relationship with a partner company. The Sites, Social Media Properties, Rental Locations, Apps, and other offerings are, collectively, the “Services.” This Privacy Notice also explains how Herc Rentals uses and discloses such information, as well as your rights and choices regarding certain uses of personal information that is collected about you.

This Privacy Notice applies to both our Sites and our Apps. To the extent our Apps collect information in ways that differ from our Sites (for example, through mobile device permissions), those distinct practices are described below, including under “Mobile Applications (ProControl)” in Section 2.

Not in Scope. Note that this Privacy Notice does not apply to information about you collected by third-party services, applications, or websites that you access separately from our Sites. The information collected or received by such third parties is subject to their own privacy policies and practices.

USER’S ACKNOWLEDGEMENT OF THIS PRIVACY NOTICE

By using any of our Services, you consent to and agree to be bound by our Privacy Policy and Terms of Use then in effect. If you do not agree with any of the Privacy Policy or Terms of Use, you should not access or use our Services.

2. INFORMATION WE COLLECT

Information You Provide to Us

Personal Information: We may collect personal information from you when you use our Services, make a reservation (even an abandoned or interrupted reservation), request an estimate of charges, rent our equipment, purchase training or other products or services, make or initiate a payment, create an online account with us, provide information to one of our sales coordinators at an equipment rental location, communicate with one of our representatives by phone, email, text message, instant messaging service, join a Herc Rentals membership or loyalty program, sign up for newsletters or our email list, participate in a survey or promotion, request information from us, use “chat” functionality on our Services, apply for a line of credit, apply for a job through the Site, sign up for job alerts, fill out a contact or feedback form, or otherwise contact us or provide us with personal information. We may also collect or receive personal information about you as part of a business acquisition, merger, or restructuring, based on our legal relationship with a partner company. Generally, the information we collect from you may include some or all of the following:

Contact information, including your name, address (e.g., city, state, zip code, country of residence), email address, telephone, and/or mobile number;
Driver’s license number, date of birth and jurisdiction of issuance;
Employer-related information, such as your title and the company’s name, address, and phone number;
Credit or debit card number, date of expiration and CVV number or security code, or other financial information;
Information for and results of credit check including date of birth;
Herc Rentals account name/number and login credentials (e.g., user ID and password or key);
Contents of emails, text messages, instant messages, chat messages, or other messages you send to us, or phone calls you make to us;
Inferences drawn from the categories described above which we may use to create a profile or customer profile about you to reflect your preferences, characteristics, behavior and attitude;
Herc Rentals loyalty program-related information, such as loyalty program number and points earned;
Information you may provide in connection with an application for a Herc Rentals credit account;
Information you may provide when applying for a job with Herc Rentals through the Site; and
Rental charges you incur and other information relating to your transactions, purchases, payments, invoices, and account activity.
Other information related to a request or inquiry of yours, or that you provide to us when you communicate, engage with, or otherwise interact with us or the Services.

When you use certain payment functionality made available through our Services, we may provide identifying, contact, account, and transaction-related information to a third-party payment platform or payment processor to facilitate the transaction. Depending on the payment method or service, payment card or other payment credentials may be entered directly with the third-party provider and may not be received or stored by Herc Rentals.

We may also collect certain health information from you in certain circumstances, such as when you ask us to accommodate a disability (e.g., by provision of hand controls), or if there is an accident and we need to work with insurance and claims management companies relating to any injury you may incur (“Health Data”).

You have choices about providing certain information. When you are asked to provide information, you may decline to do so; but if you choose not to provide information that is necessary to provide any aspect of our Services, you may not be able to use those Services.

Finally, we collect data that is not identifiable to you or otherwise associated with you, such as aggregated data. To the extent this data is stored or associated with personal information, it will be treated as personal information; otherwise, the data is not subject to this Privacy Notice.

Information Collected from Third Parties or Other Sources

Depending on the Services used and your interactions with us, we may obtain personal or other information about you from third parties or other sources and combine this information with the information we collect from and about you through the Services. Such information may include:

Information collected through one of our Apps;
Information obtained through reservations that you make through a third-party, such as through our network of independent companies licensed to operate equipment rental businesses using “Herc Rentals”;
Information obtained through transactions you complete with us or our licensees, including options you take, charges you incur, and any incidents or accidents that may occur;
Information about your credit history;
Publicly available information about you from consumer reporting agencies; and
Any other information obtained through companies that have business relationships with us, such as our licensees, affiliates, and business partners.

We may also obtain information about you from other sources, including publicly available information, when you interact or connect with Herc Rentals through its official corporate pages on third-party social networks (such as Facebook) or the “apps” on those pages. This information may include, but may not be limited to, name, username, demographic information, updated address or contact information, interests, and publicly observed data, such as from social media posts and interactions and online activity. We may combine this information with the information we collect from and about you through the Services.

Information Collected Automatically

We obtain personal or other information about you and your use of the Services and our products automatically through logging and analytics tools (including those provided by third-parties such as Google Analytics, Adobe Analytics, and other analytics, user interaction, and experience monitoring tools, which may include tools that analyze how users interact with our Services). We also obtain such information through software development kits (SDKs), mapping services, media players, security tools, and similar technologies integrated into our Site or Apps to support functionality, analytics, fraud prevention, security, and service performance, including technologies that we use to monitor the use and location of our rental equipment. Such information includes, but is not limited to:

Information about the device and network you use to access the Site and/or App, including browser type, device type, operating system, software version, Internet Protocol (“IP”) address, geolocation, phone model, phone operating system, unique device ID information, regional and language settings, and network provider and the domain name from which you accessed the Services. For more information, see the Cookies and Tracking Technologies section below.
Information about your history with the Site and/or App and how you use the Site and/or App (including your search history, the date and time you visit the Site or App, the areas or pages of the Site or App that you visit, the amount of time you spend viewing or using the Site or App, the number of times you return to the Site or App, other click-stream or site usage data, emails that you open, forward or click-through to our Site or App, and other sites that you may visit) and performance data of the Site and/or App;
If you permit the Site and/or App to access information about your location (including global positioning system (GPS) or general location information derived from the network you use to access the Services), we collect the precise or general location of any computer, mobile device, or other electronic device used to access the Site or App;
Information regarding the vehicle or equipment rented and its operation during your rental, such as the geolocation of such vehicle or equipment, or fuel status; and
Information, including geolocation information, collected through our in-equipment technology or through any other Telematics device placed in rental equipment.
Information collected may include the URL address/app visited immediately prior to or following access to our Services, Site or App.

User Accounts Created via Acquisition or Migration

As part of a business acquisition, merger, or corporate restructuring, we may receive your personal information and create an account for you on our websites or platforms based on our legal relationship with such a partner company. In this way you may be migrated into our websites or platforms. If your account was created in this manner, your information will be governed by this Privacy Policy and our Terms of Use. You retain the same rights and choices as any other user of our platform, including the ability to access, correct, or delete your information, and to opt out of certain data sharing activities. Mobile Applications (ProControl)

The following additional disclosures apply to users of the Herc Rentals ProControl mobile application (“ProControl App”). This section supplements the information described above in Section 2.

Information you provide through the ProControl App. When you create or manage an account, rent equipment, assign user permissions, upload content, or otherwise use the ProControl App, you may be asked to provide personal information such as your name, phone number(s), email address, mailing address, company name, and job title/position, as well as account login credentials (username/password) and information related to your rental transactions and equipment access.

Information Collected Through the App. Depending on how you use the ProControl App and the permissions you enable, we may collect the following categories of information through the App:

Account and Profile Information, including first name, last name, email address, phone number, mobile number, business or employer name, job title, and account credentials;
Device and App Information, including device type, operating system, unique device identifiers, App version, language settings, crash or diagnostic data, and timestamps;
Usage Information, including App features accessed, pages or screens viewed, interactions with equipment listings, rental activity, and related in-app activity;
Location Information, including general location information or, if you enable location permissions, more precise location data to help locate nearby branches, display maps, facilitate equipment access, or support equipment-related functionality. We do not use location information collected through the App for targeted advertising purposes;
Equipment and Rental-Related Data, including information associated with rented equipment, usage duration, authorization status, and telematics-related data where applicable.

Biometric authentication. The ProControl App may allow you to enable device-based biometric authentication (such as Face ID) for convenience when signing in. Herc Rentals does not receive, store, or process biometric identifiers or biometric information; biometric authentication is performed by your mobile device operating system in accordance with your device settings.

Mobile device settings. You may control app permissions (such as location services, notifications, Bluetooth, and biometric login) through your device settings. If you disable certain permissions, some features of the ProControl App may not function properly.

Mobile Analytics and SDKs

The ProControl App may incorporate third-party software development kits (“SDKs”) and embedded services to support analytics, performance monitoring, security verification, mapping functionality, media display, and other business and operational purposes.

Device Permissions

The App may request access to certain device permissions, such as location services, biometric authentication (e.g., Face ID), Bluetooth, camera, or notifications. These permissions are used solely to support App functionality and user convenience (for example, enabling secure login, locating branches, or sending operational notifications). You may enable or disable these permissions at any time through your device settings.

Advertising and Tracking Choices in the App

Depending on your device settings, you may be able to control certain App-related tracking through your mobile operating system (for example, by limiting ad tracking or disabling certain analytics permissions). The App does not respond to browser-based “Do Not Track” signals, which do not apply in the mobile App context.

Links to Third-Party Services

The App may contain links to third-party websites or services. If you access third-party services through the App, those services are governed by their own privacy policies and practices, and not by this Privacy Notice.

Cookies and Tracking Technologies

Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Sites, while others are used to enable a faster log-in process or to allow us to track your activities while using our Sites. Most web browsers automatically accept cookies but you can edit your browser options to block cookies in the future. But doing so may prevent you from accessing all functionality of the Sites.

In more detail, we use cookies, web beacons, pixel tags, JavaScript, and other tracking technologies to automatically collect certain information, including personal information, about visitors to our Site or App and interactions with our emails and online or mobile advertisements, and to allow Herc Rentals to keep track of analytics and certain statistical information which enables us to improve our Site and Apps and provide you with more relevant content and advertising on our Site, Apps, or other websites or mobile applications. These technologies may also include tools that analyze user interactions with our Services to help us understand usage patterns and improve performance. These technologies may include analytics, advertising, customer engagement, and tag management tools provided by third parties such as Google (including Google Analytics and Google Ads), Microsoft (including Bing Ads and Microsoft Clarity), Adobe (including Adobe Analytics and Adobe Experience Cloud), LinkedIn, X (formerly Twitter), and other advertising or marketing partners (including those deployed via Google Tag Manager or similar tools and/or configured based on user choices where applicable). Some of these technologies may be deployed automatically when you visit our Sites, and you may have the ability to manage certain preferences through our Cookie Preference tools, as described below.

We use cookies to track how users interact with the Sites and App, including activity such as page views, product views, and clicks. We use these cookies to help us understand how users interact with our Sites and Apps and to improve functionality, content, and user experience. This data is used for in-house analytics, as well as for our own marketing and remarketing. For example, users who abandon their cart may receive an email, text, or SMS asking if they wish to complete their purchase.

With respect to the foregoing, we contract with service providers to serve or send advertisements on our behalf. We work with these advertising service providers that collect information for purposes of delivering more relevant advertising to you. Our advertising providers may place or recognize a cookie on your computer, device, or directly in our emails and communications, and we may share personal information with them if you have submitted such information to us. Some service providers may continue to receive certain information as necessary to support core site functionality or communications, even where you have adjusted your cookie preferences. These service providers may link the anonymous information we share with them to the cookie stored on your browser or device and collect information such as your IP address, browser or operating system type and version, and demographic or purchase information. These disclosures may constitute “sharing” for purposes of cross-context behavioral or targeted advertising under applicable law.

We also use third-party cookies and other technologies to personalize and enhance certain Services, to support our Services, provide services on our behalf, facilitate business transactions on our behalf, or provide relevant advertising to you. Some of these third parties use tracking technologies including cookies, web beacons, pixel tags, log files, or Flash cookies on our Site or Apps, which may send them some of the above-referenced information.

Cookie Settings
Certain parts of our Site or App require the use of cookies to function properly. You can change your preferences for cookies on our Sites and manage certain non-essential cookies (other than “essential” cookies that are necessary for our Site to function properly) through our Cookie Preferences button. Depending on how our Services are configured, certain technologies may continue to operate where necessary for site functionality, communications, or service delivery. You are also free to set your browser or operating system settings to limit certain tracking or to decline cookies, but by doing so, you may not be able to use certain features on the Site or App, or take full advantage of all of our offerings. Please refer to your Web browser’s or operating system’s website or “Help” section for more information on how to delete and/or disable your browser or operating system from receiving cookies or controlling your tracking preferences. Please see our Cookie Policy for more information about our use of cookies on the Sites.

Do Not Track Disclosures

Our systems and Services do not currently respond to “Do Not Track” signals or Global Privacy Control (GPC) signals. To learn more about the use of cookies or other technologies to deliver more relevant advertising and to know your choices about not having this information used by certain service providers, please click here and here. You may, however, disable certain tracking as discussed above (e.g., by disabling cookies) and as set out in our Cookie Policy . On your mobile device, you may also adjust your device’s privacy and advertising settings to control whether you want to receive more relevant advertising.

Combination of Information

We may combine the information we receive from and about you, including information you provide to us, information we automatically collect through our Site and App, as well as information collected from other online sources and/or from third-party sources to help us understand our users, improve our Services, and support our communications and business operations.

3. INFORMATION USE

Herc Rentals may use the information we collect from and about you for any of the following purposes:

Responding to requests

To respond to your inquiries, fulfill your orders and requests, including purchases of training or other products or services, and otherwise consider or process your requests; we may use means such as SMS, text, or email to provide delivery notifications and order confirmations.

Reservations, rentals, and loyalty programs

To validate, confirm, verify, and track your reservation or rental or other transaction or purchase, including to process payment card transactions, facilitate payments, generate or reconcile invoices, maintain account records, or to contact you about your reservation, rental, purchase, payment, or account;
To enhance your online reservation and transaction experience, including as a way to recognize you and welcome you to the Site or App, and make the reservation or transaction process faster and smoother;
To provide price quotes based on the location at which the equipment will be used;
To communicate with you about your membership or status in one of our loyalty programs;
To track the use and location of our equipment, including, where applicable, creating geofences and location restrictions for such equipment.

Improving our site operation and content, products, or services:

To develop new products or services and to conduct analysis to enhance current products and services;
To review the usage and operations of our Site or App, and improve our content, products, and services;
To better understand how users interact with our Services over time and across devices, and, where applicable, across different websites;
To process your questions, comments, and feedback.

Personalizing our content and providing direct marketing and targeted advertising:

To provide you with content, communications, and marketing or promotional materials on the Site, App (including geo-targeted content) or via mail, email, telephone, text message, or push notifications, in each case with your consent to the extent such consent is required by applicable law;
By sending communications, including marketing or promotional messages, in certain circumstances, including cart-related reminders and audience segmentation;
To contact you with information, newsletters and promotional materials from Herc Rentals or on behalf of our business partners, licensees, and affiliates;
To contact you when necessary.

Analytics and improvement:

To use your data in an aggregated format for analytical and demographic purposes;
To address problems with the Services, or our business.

Complying with legal and ethical obligations and legal process:

To comply with applicable laws, regulations, rules and requests of relevant law enforcement and/or other governmental agencies.

Protecting rights and preventing fraud and misuse:

In endeavoring to protect our and our partners’ rights, property, or safety, and the rights, property, and safety of our users and other third parties; and
In endeavoring to protect the security or integrity of the Site, App, and our business, such as by protecting against and preventing fraud, unauthorized transactions, claims and other liabilities, and managing risk exposure, including by identifying potential hackers and other unauthorized users.

Supporting our business operations and business transactions:

As otherwise described to you at the point of data collection; and
For other purposes, as permitted or required by law.

Text messaging opt-in will not be shared with any third party for marketing purposes.

Additionally, if you use the Site or App to connect with third-party services, you authorize us to use and disclose information from and about you, on your behalf, to interact with these third-party services based on your requests, including to facilitate transactions and payments requested by you.

4. INFORMATION SHARING

Herc Rentals may disclose the personal information we collect from and about you in the following ways:

With our affiliated companies and licensees bearing the Herc Rentals brand, including subsidiaries of such companies;
With our third-party service providers that provide business, professional or technical support functions for us, including payment processors, payment platforms, billing providers, and other providers that facilitate transactions or account servicing;
With our agents, licensees, and other companies that assist us in providing a reservation or rental-related services to you, including, but not limited to, making your rental reservations; providing you with customer assistance; processing and/or confirming your transactions; providing you with the services you requested; assessing creditworthiness; billing and collecting any amounts owed in connection with the rental and membership(s); or recovering our equipment or any monies due, such as through debt collection agencies;
With payment processors, payment platforms, financial service providers, and related service providers in connection with payments and other transactions. Information disclosed for these purposes may include identifying, contact, customer account, transaction, billing, and related information. Such providers may process information to provide and improve their services, conduct analytics, prevent fraud, and for other purposes permitted under our agreements with them and applicable law;
To process, handle or otherwise respond to claims for damages, including claims or demands for bodily injury or property damage;
As necessary if we believe that there has been a violation of our Terms of Use or of our rights or the rights of any third-party;
To respond to judicial process or provide information to law enforcement or regulatory agencies or in connection with an investigation on matters related to public safety, as permitted by law, or otherwise as required by law; and
As otherwise described to you at the point of collection.
Text messaging opt-in will not be shared with any third party for marketing purposes.

Herc Rentals may also share aggregate or anonymous information with third parties for their marketing or analytics uses.

Herc Rentals may share personal information with third party platforms, including analytics providers, in order to reach individuals with more relevant content and collect performance metrics and usage information related to our Sites and our ads and content. As noted above our Site may also include cookies that enable us and third parties to collect browsing and activity information about users of our Sites, in order to, for example, analyze and improve performance, enable certain features and functionality, understand more about users and their interaction with our Site, improve functionality and user experiences, and reach users with more relevant content and ads on our Sites. This may include the use of analytics and customer engagement providers such as Adobe. As noted above, most web browsers automatically accept cookies but you can click on our Cookie Preferences button to manage certain non-essential cookies. Moreover you can usually modify your browser settings to decline cookies but doing so may prevent you from accessing all functionality of the Sites. For more information, see: Cookies and Tracking Technologies above. These disclosures may constitute “sharing” for purposes of cross-context behavioral or targeted advertising under applicable law.

Also, Herc Rentals may sell or purchase assets during the normal course of our business. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should such a sale or transfer occur, we will use reasonable efforts to try to require that the transferee use personal information provided through the Services in a manner that is consistent with this Privacy Notice.

5. YOUR OPTIONS AND ACCESS TO PERSONAL INFORMATION ABOUT YOU

Depending on the laws that apply to you, you may have a variety of legal rights regarding the collection and processing of personal information. You may exercise these rights, to the extent they apply to you, by contacting us as provided at the end of this Privacy Notice, and by following instructions provided in this Privacy Notice or in communications sent to you. Please be prepared to provide reasonable information to identify yourself and authenticate your requests. Note, however, that we may request certain reasonable additional information (that may include personal information) to help us authenticate your requests and/or to clarify or understand the scope of such requests.

We provide our customers with the opportunity to opt-out of having their information used for purposes not directly related to placement, processing, or fulfillment of a reservation or equipment rental.

To “opt out” of receiving future e-mail, SMS, text, instant message, or push notification marketing messages from Herc Rentals, you can click on the “unsubscribe” link at the bottom of an e-mail marketing message, update your information on the Account Profile page on the Site, or email us at privacy@hercrentals.com. Please allow up to 10 business days for your request to take effect. Note that if you do business with us, you may not, subject to applicable law, opt out of certain automated notifications, such as order confirmations, based on business transactions (e.g., rentals, billing notices).

To access, review, or update information stored by Herc Rentals in your account, you may visit the Herc Rentals Account Profile page on the Site, where you can view, update, correct, or change personal information about you and update your member profile, password, and associated information.

More generally, if you would like to review the personal information we have collected about you via the Sites, request that we update, correct, or delete your personal information, or submit a request to exercise your privacy rights under applicable laws, please send an email to us at privacy@hercrentals.com. Depending on applicable law, you may have certain rights regarding the sale or sharing of your personal information, including for purposes of cross-context behavioral advertising. You may exercise applicable rights by contacting us as described below or through available privacy controls on our Site.

As noted above, you may also review and change your preferences for cookies on our site and manage certain non-essential cookies (other than those that are essential, required, or strictly necessary for our Site to function properly) through the Cookie Preferences button, available on our footer.

If you want to limit or prevent our ability to receive location information from your device, you can deny or remove the permission for certain services to access location information or deactivate location services on your device. Please refer to your device manufacturer or operating system instructions for instructions on how to do this. Please note, however, that we may still collect telematics and/or geolocation information for rental equipment that contains such functionality. This may also affect the functionality of the ProControl App, including branch location and certain equipment access features.

COLLECTION OF PERSONAL INFORMATION

This section uses certain terms that have the meaning given to them in the California Consumer Privacy Act of 2018 or CCPA (as amended by the California Privacy Rights Act of 2020) and its implementing regulations.

For details on the personal information (as defined by the CCPA) Herc Rentals collected about California residents in the last 12 months, the sources of that information, Herc Rentals’ business purposes for collecting that information, and the third parties with whom Herc Rentals disclosed personal information, please refer to the above corresponding sections of this Privacy Policy entitled INFORMATION COLLECTION, INFORMATION USE, AND INFORMATION SHARING, and refer to the following:

INFORMATION COLLECTION – Categories of personal information collected and how the information was collected. This information includes the following categories of personal information as defined under California law:

We note that consumer information that has been “deidentified” in accordance with the CCPA is not considered “personal information.”

You have the right to request that Herc Rentals disclose the categories of personal information Herc Rentals collected used, or disclosed about you; the categories of sources from which the personal information was collected; the business or commercial purposes for which Herc Rentals collected or disclosed (if applicable) that information; the specific pieces of personal information Herc Rentals collected about you; and the categories of third parties to whom Herc Rentals disclosed such information about you in the last 12 months. You will be required to provide certain information which Herc Rentals will use to verify your identity and your request.
Right to Access. You have the right to request access to the personal information specific to you individually, that Herc Rentals collected, used, or disclosed about you in the last 12 months. You will be required to provide certain information which Herc Rentals will use to verify your identity and your request.
Right to Correct. You have the right to request Herc Rentals to correct inaccurate personal information about you.
Right to Delete. You have the right to request Herc Rentals to delete personal information that Herc Rentals has collected about you. Please note that certain exceptions apply to this right, such as when Herc Rentals must retain your information to comply with law. Herc Rentals will notify you of any such exceptions as applicable to your request. Herc Rentals will also maintain a record of your deletion request. To exercise this right to delete, please submit your request by e-mail at privacy@hercrentals.com. You will be required to provide certain information which we will use to verify your identity and your request.
Right to limit use of sensitive personal information. You have the right to limit uses or disclosures of sensitive personal information to those authorized by the CCPA. However, as noted above, we do not use or disclose sensitive personal information beyond the purposes authorized by the CCPA. We only collect, use, and disclose your sensitive personal information to provide services to you.
Right to Non-Discrimination. You have the right not to receive discriminatory treatment by Herc Rentals for the exercise of any of your CCPA rights. Herc Rentals may offer certain financial incentives, charge reasonable fees related to your requests, or deny your right to know, right to access or right to request deletion in accordance with applicable law.

AUTHORIZED AGENT

You can exercise your CCPA rights yourself or you can designate an authorized agent to make a request on your behalf. Your authorized agent must provide written authorization demonstrating that they are authorized to act on your behalf, and we may also require you to verify your identity directly with us. 7. YOUR CANADIAN PRIVACY RIGHTS

Residents of Canada are permitted to request and obtain from us information respecting the existence, use, and disclosure of their personal information as well as access to that information (subject to certain exceptions pursuant to applicable laws). 8. THIRD-PARTY WEBSITES AND SERVICES

The Site, App, and email messages from us may as a convenience contain links to third-party websites, services, or payment platforms, which may have privacy policies and practices that differ from our own. For example, when you elect to use certain payment functionality, you may be redirected from our Site or App to a third-party payment platform, where you may provide payment or financial information directly to that third party. You should be aware that the collection, retention and use of any data you provide on such websites or services will be governed by the privacy policy of the company providing the website or service and not by this Privacy Notice. 9. CHILDREN’S PRIVACY

Protecting children’s privacy is important to us. We do not direct the Site or App to, nor do we knowingly, collect any personal information from children under the age of 16. We do not have actual knowledge that we sell or share personal information of consumers under the age of 16. 10. DATA SECURITY

We are committed to protecting the security of your personal information. We have taken certain physical, administrative, and technical steps, including encryption, to safeguard the information we collect from and about our customers, users of the Services, and Site and App visitors. While we endeavor to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will be effective or sufficient. Thus, while we employ security measures to prevent unauthorized access to information that we collect online, we cannot guarantee the security of your personal information. In addition, you should be aware that internet data transmission is not always secure, and we cannot warrant that information you transmit utilizing the Services is or will be secure.

Personal information is stored on servers in the United States and is subject to the laws of the United States, where the data protection and other laws may differ from those of other countries. Herc Rentals reserves the right, at its sole discretion, to change, modify, add, remove, or otherwise revise portions of this Privacy Notice at any time. Please review the Privacy Notice periodically for changes.

This Privacy Notice is subject to any agreements, including rental agreements, master agreements, credit applications and agreements, and the Terms of Use that govern your use of the applicable Services, App, and/or Site. This Privacy Notice does not apply to information from or about you collected by any third-party services, applications, or websites that you access separately from the Services.
