Canada Additional Charges Schedule

The following terms and conditions govern the additional charges, surcharges, and fees applicable to equipment rentals in Canada. These charges are separate from and in addition to the base rental rate set forth in the Rental Agreement. All charges described herein are collected by Matthews Equipment Limited o/a as Herc Rentals ("Herc") as revenue and are subject to change at Herc's sole discretion. None of the charges described below constitute a tax or government-mandated charge unless expressly stated otherwise.

1. Emissions and Environmental Surcharge (EES)

Herc applies an Emissions and Environmental Surcharge ("EES") to each Rental Agreement transaction, as applicable. The EES is assessed to offset costs and expenditures incurred by Herc in connection with environmental compliance and sustainability activities, including without limitation: (a) compliance with applicable federal, provincial, and local environmental laws, regulations, and rules governing Herc’s business operations; (b) implementation of voluntary conservation initiatives; (c) procurement of engines and equipment incorporating advanced emission control technologies; (d) handling, management, and cleaning of equipment, disposal of fluids including motor oil, grease, and hydraulic fluid, and maintenance of wash bay water treatment systems; and (e) disposal of filters, tires, batteries, and shop waste in accordance with applicable regulations.

2. Preventative Maintenance Charge (PM)

Herc applies a Preventative Maintenance Charge ("PM Charge") to Rental Agreement transactions for generators, compressors, heaters, pumps, and other applicable equipment. The PM Charge is assessed to recover costs associated with performing preventative maintenance services, whether conducted at the Customer's site or at a Herc facility, and satisfying applicable inspection requirements.

3. Cleaning Charges

All equipment must be returned to Herc in clean condition. In the event equipment is not returned clean, Herc assesses a cleaning charge based on the time and level of service required to restore the returned equipment to rental-ready condition. Cleaning charges are categorized as follows:

Standard Cleaning, meaning a basic cleaning service for equipment returned with minimal soiling;
Heavy Cleaning, meaning a thorough cleaning service for equipment returned with moderate buildup or dirt accumulation; and
Extra Heavy Cleaning, meaning an intensive cleaning service for equipment returned with significant buildup requiring extended labor and attention.

Specialty cleaning charges may apply to certain equipment types, including without limitation, sprayers or equipment with lines that have not been flushed prior to return; trucks or vehicles requiring professional detailing; and masonry equipment or mixers returned with dried concrete in or on the machine.

4. Transportation Services Surcharge (TSS)

When transportation services, including delivery and pickup, are requested by the Customer, a Transportation Services Surcharge ("TSS") will apply in addition to the applicable transportation charges, as indicated in the Rental Agreement. The TSS is comprised of two components, as follows:

Fixed Component, meaning the amount of the TSS that is intended to defray costs associated with delivery vehicles, including vehicle standing costs, running costs, and depreciation. The Fixed Component is currently 13%, subject to a minimum charge of $13.00 CAD.
Variable Component, meaning the amount of the TSS calculated as determined by reference to the Canadian Average Monthly Retail Diesel Fuel Prices reported by the Government of Canada. The applicable diesel fuel price input is derived from the Government of Canada's Average Retail Prices for Regular Gasoline monthly average for the month immediately preceding the billing month, as available at www.nrcan.gc.ca. The applicable Variable Component is determined by applying the relevant diesel fuel price to the Transportation Surcharge Matrix.

The total TSS percentage is calculated by combining the Fixed Component and the applicable Variable Component, updated on the first billing day of each month.

TSS percentages, applicable thresholds, and calculations are subject to change without prior notice and at Herc’s discretion.

5. Toll Management Services

Herc provides an optional toll management service enabling the Customer to utilize cashless toll lanes on most major tollways. If the Customer elects to use this service, no additional action is required. Any toll charges incurred during the rental period will be invoiced to the Customer's account, together with an applicable administrative fee.

To decline this service, the Customer must either pay applicable tolls directly at cash-accepted toll booths or use a personally funded transponder.

6. Refueling Services

All equipment, including vehicles, must be returned with a fuel tank filled to the same level at which it was received. In the event equipment is not returned with a fuel tank with the required amount of fuel, Herc assesses a refueling service charge.

The refueling service charge is assessed to recover Herc’s direct and indirect costs of refueling equipment and does not constitute a retail sale of fuel. The applicable and current refueling service charge is posted at the renting Herc location.

Dyed diesel fuel should not be used with any on-road equipment or vehicle. Customer shall be solely responsible for all fines, penalties, and damages incurred by Herc arising from Customer’s introduction of dyed diesel fuel into any on-road equipment or vehicle.

7. Other Charges

Lost Keys and Key Fobs: In the event a Customer loses an equipment key or key fob, or locks a key or key fob inside the equipment, Herc will charge the Customer the replacement cost of the key or key fob, together with any applicable delivery, recovery, or towing fees and an additional administrative fee.

Surcharges and Other Fees: All surcharges and other fees, including any government-mandated surcharges and pass-through fees, may appear as separate line items on the Rental Agreement and/or invoice. Herc shall comply with all applicable government-mandated surcharge and pass-through fee requirements.
